Warehouse/retailing, Dundee.
The client operated a wholesale stationery business on Wester Gourdie Industrial Estate, Dundee , which allowed for industrial and warehousing uses. The business was operated by members of the client’s family and six additional employees. The Council had issued an Enforcement Notice that an unauthorised change of use had taken place from warehousing to retail. The case hinged around the percentage element of retail, which took place, in relation to wholesale selling and warehousing, in an area where planning policy allowed that a certain element of retail to the public could be allowed ancillary to wholesaling; and whether the retail element threatened established shopping centres.
